Under the Education Services for Overseas Students (ESOS) Act 2000, overseas students on  a student visa are permitted to undertake additional study (that is, a course of education or training) at the same time as the principal course for which they hold a student visa through a CRICOS provider.

Section 5 of the ESOS Act defines an overseas student as:

  • A person (whether inside or outside Australia) who holds a student visa, as defined in regulation 1.03 of the Migration Regulations 1994, including:

(aa)  a Subclass 500 (Student) visa;

                     (a)  a Subclass 570 (Independent ELICOS Sector) visa;

                     (b)  a Subclass 571 (Schools Sector) visa;

                     (c)  a Subclass 572 (Vocational Education and Training Sector) visa;

                     (d)  a Subclass 573 (Higher Education Sector) visa;

                     (e)  a Subclass 574 (Postgraduate Research Sector) visa;

                     (f)  a Subclass 575 (Non-Award Sector) visa;

                     (g)  a Subclass 576 (Foreign Affairs or Defence Sector) visa.

IMPORTANT NOTICE:
RTOs are not accredited to deliver Nationally Recognised Training to international students on a student visa. If you are an international student on a student visa, enrolling with a non-CRICOS registered provider is a breach of your visa conditions.

Breach of your visa conditions may result to cancellation of your visa status.

Any additional study done through an RTO which is not a registered CRICOS provider will not be formally recognised and is in direct breach of the terms and conditions of the ESOS Act.

Aside from any certificate you receive being null and void, you may also have your student visa cancelled and risk deportation.

Australian employers are obliged to check the validity of all certificates and report any breaches.

CRICOS RTO’s must be approved by and registered with the Department of Education, Skills and Employment who issue each RTO an individual CRICOS Provider Code.

As a CRICOS provider, National Training College must comply with all requirements under the ESOS Act and provide each overseas student who enrols in one of its courses with a written Confirmation of Enrolment (CoE).

Student visa holders can complete a First Aid, CPR  and Child Care First Aid course with National Training College and not be in breach of their visa conditions.
